By registering and/or using this website, you agree to the following terms, rules, and regulations without limitation or qualification (“Terms and Conditions”).

We may, at any time, revise these Terms and Conditions.  You are bound by such revisions and should therefore periodically review these Terms and Conditions.  Your use of this website shall indicate your acceptance of these Terms and Conditions.  If you do not agree to the Terms and Conditions, please do not use this website.

1. Travel Information

  • Cole Voyages, LLC offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Cole Voyages, LLC does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that Cole Voyages, LLC acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the clients’ benefit, and on the express condition that Cole Voyages, LLC shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.
  • Our website displays information about travel destinations, airfare, hotels, tours, packages, insurance, cruises, transportation, foreign currency, schedules, travel companies, and other travel-related items.
  • This information is supplied to us by third-party providers, such as tour operators, airlines, hotels, and other transportation suppliers (“Service Provider”).  We have taken reasonable care to ensure it is correct and up to date; however, we cannot check the accuracy of such information.
  • Service Providers provide the services which make up your travel booking.  The Service Provider provides these services following their own Terms and Conditions – some of these may limit or exclude the supplier’s liability to you.
  • We accept no responsibility for information supplied to us by Service Providers.  We recommend you confirm all information contained on or linked from our website with the Service Provider.
  • The details of the prices, packages, tours, flights, and other information displayed on the website are subject to change without notice.  The travel products and services described on the website are subject to availability and the Service Provider’s terms and conditions.
  • Hotel ratings (if applicable) that may be reflected on this site are provided by the respective Service Providers.  These hotel ratings are based upon customer reviews, not our personal experience.  We strongly encourage you to do independent research on hotel ratings, if desired. 
  • All Service Providers (such as hotels, airlines, rental cars, tour operators, etc) are independent contractors that are not affiliated with Cole Voyages, LLC.  We cannot be held liable for actions, omission, errors, representations, warranties, negligence, breach of contract, personal injury, death, property damage, or any other damage or out-of-pocket expense resulting from an action of a Service Provider.  Cole Voyages, LLC has no liability nor obligation to refund due to any delay, cancellation, overbooking, strike, force majeure, terrorist activity or other causes beyond our control.  All refunds will be subject to the terms and conditions of the individual Service Providers.  Cole Voyages, LLC is not responsible for delays, omissions, rerouting, interference by governmental or legal authorities
  • All documents issued to travelers are non-transferable.  Such documents may include, but are not limited to, airline tickets, hotel vouchers, tour vouchers, or any other document used to confirm an arrangement with a Service Provider.  Such documents may also be subject to conditions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation or amendment fees.  It is your responsibility to familiarize yourself with these conditions.
  • All travel documents are required to match the traveler’s government-issued photo id (e.g. driver’s license or passport).  It is the responsibility of the traveler to provide complete and accurate names (including proper spelling) as well as dates of birth and passport numbers (where required).  
  • If, for any reason, any Service Provider is unable to provide the services for which you have contracted, your remedy lies against that Service Provider, and not against us.  In the event we received payment by credit card, you agree that you will not seek to chargeback or recover your payment or any other losses from us.
  • You are responsible for obtaining all passports, visas, required vaccinations, and other health and safety information as required.  Each country also has individual requirements such as the number of blank pages in a passport and validity of the passport (e.g. six months beyond travel date).  You must verify with each country’s specific government the requirements and adhere to such.

2. Prices and Specials
Special conditions may apply to the prices set out on the website.  To determine such circumstances, you must contact the relevant Service Provider or us.  In addition to the prices set out on the website, you may be required to pay certain taxes, government fees, resort fees or other charges that are paid directly to the hotel, rental car or tour company.

“Specials” are available for a limited time and are advertised on behalf of the Service Providers.  We do not guarantee that you are eligible for any special discount until you have made a deposited booking with the Service Provider, and agreed with the Service Provider’s terms and conditions.  Special rates are available on a first come, first serve basis and can expire at any time.  Rates are not guaranteed until you have booked and paid your deposit. 

3. Insurance
Many of issues or problems you may encounter can be covered by travel insurance.  We highly recommend that you take out insurance to provide adequate coverage for medical expenses, personal accident, loss of baggage, rental car collision or losses or damage, and for curtailment or cancellation of your trip.  Please note that there may be exclusions to insurance coverage:  some may have deductibles, refunds only in the form of travel credits, etc.  The details of the travel insurance vary by provider and therefore it is your responsibility to be familiar with the insurance coverage purchased and ensure that the coverage meets your travel needs.

NOTE:  Many credit cards provide some level of travel insurance.  It is the responsibility of the traveler to research what, if any, coverage they may be entitled to from their credit cards and then purchase additional coverage if desired.

4. Special Requests 
Should you have any special requests (such as seating arrangements, hotel bed type, specific rental car make or model, etc.), you must advise us at the time of the booking and clearly note it on booking.  We will pass reasonable accommodation for such requests along to the Service Providers;  however, we regret that we cannot guarantee that your special request will be fulfilled.  Failure to meet any special request does not signify a breach of contract on our part. 

5. Suitability of Travel Products and Services
We do not represent that any travel products and services set out on our website will be suitable for you.  You release us from any claims concerning the travel products and services described on our website, including but not limited to, claims that the travel products and services are not suitable.  Service Providers are independent parties over which we have no control.  The information and description given about the Service Providers and their products are based on our inquiries and are believed to be accurate.

6. Tickets and Departure/Arrival Times
All reference to departure or arrival times on our website are for guidance only and are subject to amendment by the wholesalers and/or suppliers before actual booking.  It isn’t until full payment has been made and you are ticketed that the departure times are set.  Occasionally changes to flight times may occur after tickets have been issued; in such cases, you will be advised of such before your initial trip departure, provided the personal information you provided to us is correct and up to date.

7. Intellectual Property and Site Usage
All software, design, text, graphics and other content created by us or for us, that appears on this website, and the design and layout of this website, are owned or licensed by us and are protected by intellectual property laws of the United States of America.  We own the copyright on the website as a collective work and/or compilation and in the selection, coordination, arrangement, and enhancement of such content.  Unauthorized usage or copying of data or content from this site may violate state or federal laws.  You agree not to copy, modify, adapt, reproduce, translate, distribute, transmit, reverse engineer, frame, decompile, or disassemble any aspect of our website. 

8. Linking
We may provide links to other websites such as governmental or service provider sites.  These links are provided for your convenience only, and we make no warranties or representations whatsoever regarding any other website, nor are we responsible for the linked content.

If you suffer any loss or damage from visiting another linked website or using a product or service, we are not liable.

9. Measurement of Usage
Use of this website may provide us with demographic information such as location, browser, device, etc. This information is collected anonymously and is used along with cookies to improve our site and inform marketing campaigns and advertisements.  

10. Confidentiality
You may use this website to communicate with us either by email, submission of the Contact Us form, or telephone.  Do not send confidential information over the Contact Us form.  Cole Voyages, LLC is not responsible for your personal information if sent via a non-secure channel.

11. Indemnity
You indemnify us and our affiliates, officers, employees, and agents against all losses, costs, damages, claims, and expenses arising from:

  • any breach of these Terms and Conditions by you;
  • any act or omission by you or an officer, employee or agent of you;

12. Governing Law
To the maximum extent permitted by law, these Terms and Conditions and your use of the Website is governed by the laws of the State of Ohio.  You hereby consent to the non-exclusive jurisdiction and venue courts in the State of Ohio in all disputes arising out of or relating to the use of this website and these Terms and Conditions.

13. Amendments
Except as otherwise specified, we may amend these Terms and Conditions at any time without notice and will take effect immediately when they are posted on our website.

14. Termination
We may terminate Terms and Conditions, and any other agreement between us, immediately if you breach any of these Terms and Conditions.

15. Our Relationship
No agency, partnership, joint venture, employee-employer, or franchisor-franchisee relationship is intended to be created between you and us by these Terms and Conditions.
